This is the last will and testament of

William Dengate of Wittersham in the isle of Oxny in the County of

Kent yeoman made this twenty sixth day of December in the year of

our lord one thousand eight hundred and seventeen I make nominate

constitute and appoint my brother in law William Bates of Tenterden in the

said county farmer and Peter Parton the younger of Wittersham aforesaid

miller executors of this my last will and testament I give unto my dear

wife Anne all my stock of wines and other liquors provisions and food of every

sort and that shall be in or about my dwellinghouse at the time of my

decease for her own absolute use and benefit and I give unto her my said

wife all her clothes wearing apparel and rings for her own use I give

unto my said wife Anne the sum of sixty pounds sterling to and for her

own absolute use and benefit I give and ___ unto the said William Bates

and Peter Parton and their heirs all that my messuages or ___ with their

barn stable outhouses edifices buildings ___ yards gardens orchards and ___

several pieces of land thereto belonging containing by admeasurements ? right

­­­­___ more or less with the appartances situate and being in Wittersham

aforesaid and now in the possession of myself and my tenants and also all

that my cottage or tenement standing near to the aforesaid messuage in the

occupation of George Holdstock with the appartances and also all and every

messuages lands tenements heriditaments and real estate whatsoever and

wheresoever with the appartances unto them the said William Bates and

Peter Parton their heirs and assigns for ever but nevertheless upon the trust

and for the ___ intents and purposes hereinafter mentioned expressed and

declared of and concerning the same that is to say upon trust that they the

said William Bates and Peter Parton or the survivor of them of the heirs

of such survivor should and so as soon as to conveniently may be after my

decease sell and absolutely dispose of my said messuages lands tenements

heriditaments and premises and all other my real estate goods and ___ to

them as aforesaid with their appartances together or in parts and by public

___ auction or by private contract as to them or him shall seem expedient for

the best price or prices in money that can be reasonably had or obtained for the

same and to convey the same accordingly and I will and declare that the

receipt or receipts of the said William Bates and Peter Parton or the survivor

of them or his heirs or assigns for the money for which the same so

respectively ? sold shall from time to time be a sufficient discharge or sufficient

discharges to the purchaser or purchasers of the said heriditaments and premises

or any part thereof for his her or their purchase money or for so much thereof

as shall be therein acknowledged or expressed to be received and that such

purchaser or purchasers his her or their heirs executors administrators or

assigns or any of them shall not afterwards be answerable or accountable for

any loss _application ? or nonapplication ? of such purchase money so received or

any part thereof and my will further is that the monies that shall arise

by or from such sale or sales as aforesaid shall be deemed to be part of my

personal estate and that the ___ yearly rents and profits of the said

heriditaments and premises in the ___ until the same shall be sold or

of so much thereof as shall be remaining unsold shall be deemed to be part

of my personal estate and that the same monies and rents and profits shall

be subject to the dispositions hereinafter made concerning my personal estate

and the annual income thereof respectively I give an bequeath unto the said

William Bates and Peter Parton all and every of my household furniture and of

the household goods plate ? plated ? goods china and ready monies and

securities for money corn hops stock cattle husbandry tackle chattels debts effects

and personal estate whatsoever and wheresoever and of what nature kind or

quality soever the same be (not by me herein before already otherwise disposed

of) whereof I shall die possessed ? or which shall be any ways due owing or

calling ? or belonging unto me at the time of my decease and all my estate and

interest therein and also all and singular the monies herein before directed to

constitute part of my personal estate to hold the same and every part thereof unto

them the said William Bates and Peter Parton their executors administrators

and assigns upon trust that they my said executors and trustees or the ___

survivor of them his executor or administrators shall and so as soon as

conveniently may be after my decease sell and convert into ready money all or

such part or parts of my personal state as shall not consist of monies or

securities for money and shall do call ? receive ? and get ? in all such part or

parts thereof as consist of monies or securities for money and upon further

trust that they my said trustees and executors or the survivor of them or the

executors or administers of such survivor shall and do in the first place

by and out of the monies to arise from the sale or sales of my said messuages

lands and heriditaments real and personal estate herein directed before  to be

sold and to be collected received and got in as aforesaid pay and discharge all

such just debts as I shall owe at the time of my decease unto any person or

persons whomsoever my funeral and testamentary charges and all other

incidental expenses and also the said legacy of sixty pounds herein before

___ ___ given and bequeathed unto her my said wife Anne and from and

afore ? all such payments are made as aforesaid upon further trust that

they my said trustees and executors or the survivor of them or the

executors or administrators of such survivor do and shall put and place

or lay out and invest in their or his names or name upon good real ?

securities or in the parliamentary funds of this kingdom at interest

the clear residue of the said trust monies and from time to time sell

such stocks or funds and call in all or any part of the same so placed out

to invest and from time to time invest and place out the same again

upon securities or the same or the like nature as often as they or he

shall think fit and shall and do pay the interest dividends and yearly

proceed of the said clear residue of the said trust monies as the same

shall come in and be received unto my said wife Anne and her assigns

for and during the term of the natural life and from and after the

decease of the said Anne upon further trust that they the said

William Bates and Peter Parton or the survivor of them his executors

or administrators shall and do pay share and divide the said clear

residue of such trust monies or assign and transfer the security or securities

in or upon which the same be then placed or invested unto

and equally among my two brothers James Dengate and David Dengate

share and share alike to and for his and their several use and uses

to whom I give and bequeath and order and direct the same to be paid

accordingly and my will and mind further is that they my said executors

and trustees or either of them their or either of their heirs executors

or administrators shall not be charges or chargeable with or

accountable for any more of the aforesaid trust estates monies and premises

then they respectively shall actually receive or shall come to their

respective hands by virtue of this my will nor with or for any loss or

losses which shall or may happen of the same estates and monies

premises or any part thereof so as such loss happens or happen without

their wilful default nor of them for the other of them or for the arts

deeds receipts or disbursements of the other of them but each of them for

his own particular art deed receipt or disbursement only and also that it

shall and may be lawful to and for my said executors and trustees and

each of them their and each of their executors and administrators in

the first place by and out of the aforesaid respective trust estates monies

and premises to deduct and reimburse himself and themselves respectively

all such losses costs charges and expenses as they or each of them

shall respectively sustain expend or be put unto for or by

reason or ___ of the several trusts thereby in them reposed ?

in their relation to the said estates monies and premises respectively

or the management and execution thereof or any other this in any ___

relating thereto together with a suitable and proper allowance for their several

___ trouble loss of time and attendances in and about the aforesaid trusts in

___ whereof I the said William Dengate the testator have to this my last

will and testament contained in this and the preceding sheets of paper

set in hand and seal (to wit) my hand to these preceding sheets and

had and my seal to this last sheet the day and year first above written

Wm Dengate the writing contained in this and these preceding sheets

of paper was signed and sealed by the above William Dengate the testator

and by him published and declared as and for his last will and testament

in the presence of us who in his presence at his request and in the

presence of each other have hereunto subscribed our names as witnesses
